RedAlert Terms of Service

1. Agreement and operator

These Terms govern your use of the RedAlert applications and the RedAlert website at redalertus.com (the "Services"). The Services are operated by MIRA Safety, LLC ("RedAlert," "we," "us," or "our"), at 1713 Hur Industrial Blvd., Cedar Park, TX 78613, United States. You may contact us at [email protected].

By accepting these Terms through the Services, you agree to them and to the Acceptable Use Policy at https://redalertus.com/legal/acceptable-use-policy. Our Privacy Policy at https://redalertus.com/legal/privacy-policy separately explains personal-information handling. Accepting these Terms is not a substitute for a separate privacy consent required by law.

If you do not agree, do not create an account or use the Services. Any additional app-store license terms apply to the extent relevant to your download; they do not replace rights you have under mandatory law. These Terms do not govern purchases from a separate MIRA Safety store or the use of a separately offered simulator unless its terms expressly say so.

2. Eligibility and your account

You must be at least 13 and meet any higher minimum age required where you live. If you are under the age of legal majority, you may use the Services only with a parent or legal guardian's permission and supervision. You must have authority to agree to these Terms. If you act for an organization, you represent that you can bind it.

Provide accurate account information and keep it reasonably current. Use only accounts and sign-in credentials you are authorized to use. Protect your sign-in method and tell us promptly if you believe your account has been misused. You are responsible for activity you authorize; nothing in this clause makes you responsible for conduct beyond your control where applicable law provides otherwise.

We may require reasonable identity or account verification to prevent abuse or protect your account. An account status change, suspension, or logout is distinct from account deletion.

3. What RedAlert provides

RedAlert provides informational alerts based on selected areas and categories, access to published safety information, report submission and review, and communication with the administration team. Available features depend on the app version, selected area, source availability, permissions, account status, and release configuration.

Information may originate from official sources, resident reports, third-party news, or automated processing. We do not control the speed, accuracy, or completeness of an external source. Automated classification can assign an incorrect location, category, or severity. A publication or moderation decision is not an independent certification of the information.

We may correct, hide, remove, or update information and change feature availability. Correcting or removing an item does not necessarily retract a notification or alert already delivered or remove a copy another person saved. When a change materially affects a contractual or statutory right, we provide the notice or remedy required by law.

4. Emergency limitations and safe use

RedAlert is not 911, an emergency dispatch system, or a substitute for official warnings, evacuation orders, professional advice, or your own immediate safety judgment. Do not use report submission, Contact Us, or support to request emergency assistance. In an emergency, call 911 in the United States or the appropriate local emergency number.

Alerts can be delayed, missing, duplicated, expired, geographically imperfect, or incorrect. The absence of an alert does not mean a location is safe. A map, severity label, or report must not be treated as permission to enter a hazardous area or as an evacuation route. Follow instructions from competent public authorities and consult official information directly.

Notification delivery depends on networks, device permissions, operating-system behavior, battery settings, service providers, and your subscriptions. Ordinary push notifications may not override silent mode or Focus/Do Not Disturb. Keep other warning channels available.

Never take a photograph, submit a report, or interact with the app while doing so would endanger you or others, including while driving. The Emergency and Accuracy Disclaimer at https://redalertus.com/legal/emergency-disclaimer explains these limits further.

5. Reports, media, and content you submit

You retain ownership of content you submit, subject to rights held by others. You represent that you have the rights and permissions needed to submit it and to authorize the uses described here. Do not upload material that unlawfully reveals another person's private information or infringes their rights.

You grant us a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, format, and make technical or editorial adjustments to your submitted content only as reasonably necessary to operate the Services: reviewing a report, displaying approved material, correcting presentation or location, creating an alert from a report, providing support, and enforcing safety rules. This license is not permission to sell your content for unrelated purposes or use it in unrelated advertising. Uses outside this license require your separate permission or another independent authorization under applicable law.

The license lasts while the content is lawfully retained for those purposes and ends for content we delete, except to the limited extent necessary for permitted retained records or backup handling described in the Privacy and Account Deletion Policies. Account deletion is not defeated by this license.

Reports may be reviewed before public display. We may ask for clarification, correct a location or category, decline publication, restrict media, or remove material that violates these Terms or creates a safety or privacy concern. We do not promise to publish a report or to respond within an emergency-response timeframe.

Publishing anonymously changes the author display label. Authorized administrators may still identify the author, and the report's text, precise location, and media may identify you or someone else. Review the Privacy Policy before submitting. Approved report-detail links may be publicly accessible even if other app features require sign-in.

6. Acceptable use and content concerns

Use the Services lawfully and responsibly. Do not knowingly submit false emergency reports, impersonate authorities, harass people, expose private information, encourage unsafe conduct, distribute illegal content, manipulate report location or severity to mislead others, interfere with systems, or misuse another person's account.

The Acceptable Use Policy provides further rules. To report harmful or unlawful material, use an available in-app reporting feature or contact [email protected] with the report or alert link and a description of the concern. For account-related assistance, visit https://redalertus.com/support. Do not resend illegal imagery or unnecessary sensitive information when reporting a concern.

We may investigate and take proportionate action, including restricting a submission, removing content, limiting features, suspending an account, or terminating access. Where appropriate and legally permitted, we provide the reason and a way to request review. An urgent safety or security issue may require action before notice.

7. Our content and third-party services

Except for your content and third-party materials, we or our licensors own the Services, software, branding, and related intellectual property. We grant you a limited, nonexclusive, nontransferable right to use the Services for their intended personal or authorized organizational purpose while you comply with these Terms. Mandatory rights to interoperability, lawful security research, or other legally protected activity are not waived.

Do not falsely imply that RedAlert or an official agency endorses you. Respect source attribution and third-party rights. News, maps, official-source information, and external links may be subject to their providers' terms. We do not control an external site's availability, data practices, or content.

8. Charges and separate transactions

RedAlert's current release does not offer in-app purchases or paid RedAlert subscriptions. Your network or mobile-service provider may charge for connectivity and data. Purchases from other services or stores are separate transactions governed by their terms. If we introduce paid features, we will provide the relevant prices and payment, renewal, cancellation, and refund terms before you purchase.

9. Ending use and deleting an account

You can stop using the Services at any time. To request deletion of your account and associated personal information, email [email protected]. The Account Deletion Policy at https://redalertus.com/legal/account-deletion explains the process. Uninstalling, signing out, or having an account suspended does not itself delete your information.

After termination, provisions that need to survive to resolve an existing matter, including applicable ownership, permitted retention, liability, and dispute provisions, continue only to the extent lawful. Your privacy and deletion rights remain subject to applicable law and the published policies.

10. Warranties and limits of liability

To the extent permitted by applicable law, the Services are provided on an "as available" and "as is" basis. We do not warrant uninterrupted availability, complete incident coverage, error-free content, successful notification receipt, or suitability for a safety-critical decision. We do not guarantee that a report will be approved or acted on by an authority.

To the extent permitted by applicable law, we are not liable for indirect or consequential losses, loss of profits, or losses caused by inaccurate third-party information or a failure or delay of an alert. This allocation of risk does not exclude liability that cannot legally be excluded, including any applicable liability for fraud, willful misconduct, gross negligence, or death or personal injury. It does not limit mandatory consumer remedies.

If applicable law does not allow a disclaimer or limitation, that provision applies only to the lawful extent. Nothing in these Terms excuses us from legal duties that apply to the Services. There is no fixed monetary liability cap in these Terms.

11. Disputes and applicable law

Please contact [email protected] with a concern so we can try to resolve it. Informal contact is encouraged and does not prevent you from seeking urgent relief, using a regulator, filing in a court with jurisdiction, or exercising another protected right.

These Terms are governed by the laws of the State of Texas, subject to mandatory laws and consumer protections that apply to you. A dispute may be brought before a court with competent jurisdiction, subject to any mandatory forum rights you have. These Terms do not impose mandatory arbitration or a class-action waiver.

12. Updates and general provisions

We may update these Terms to reflect changes to the Services or legal obligations. We publish the revised Terms and provide reasonable notice of material changes where required. If a change needs your affirmative agreement, we request it. Changes do not retroactively remove rights or apply to an existing dispute where that would be unlawful.

If one provision is unenforceable, the rest remains effective to the extent it can lawfully operate. A failure to enforce a provision once is not a continuing waiver. These Terms and the policies expressly incorporated in them describe the agreement for the Services, without limiting rights or disclosures that the law requires.
